1. Mr Charles Brown submitted the following question -

'What actions are the council taking, or intending to take, to measure the effectiveness of Allerdale's carbon reduction initiatives over the next ten years?’

 

Councillor M Johnson responded by saying;

‘Allerdale carbon reduction initiatives over the next 10 years will be part of the Scrutiny process as per the previous motion’

 

Mr Brown asked a supplementary question;

‘There were references made by councillors about actions that are already undergoing so pertinent to those, if there has been no thought by the council about future actions being taken how are those that are undergoing being measured in their effectiveness?

 

Councillor M Fitzgerald responded by saying;

‘The option is available for Scrutiny to prepare reports for Executive and it’s called pre-Scrutiny and I want to emphasise again that the subject is so important it cannot be decided in one evening by a 30 minute discussion. It needs to be investigated by Scrutiny then reported back for us to look at embedding it in council policy. The Scrutiny process is open to the public so you can come and join us in that process. What we will ensure is the Scrutiny review process will look at how the council’s progress is being measured.

 

 

2. Dr Ruth Balogh submitted the following question -

‘Will Allerdale Council undertake to act against climate change by doubling the tree cover from current levels across the Borough by 2045?’

 

Councillor M Fitzgerald responded by saying;

‘I don’t know that we can commit to doubling it, as we are not the land owners for the whole of Allerdale, but certainly increasing the number of trees as much as we can is something we can commit to. For a start I have been informed that the Woodland Trust are doing a tree planting campaign on 30 November and I would like the council to be fully engaged in that.

 

 

3. Ms Jill Perry submitted the following question -

‘Will Allerdale Borough Council join with us to put pressure on the County Council to strengthen the extremely disappointing resolution which they passed on climate change and call on them to declare a climate emergency and set in progress a plan to reduce emission to net zero by 2030?’

 

Councillor P Scott responded by saying;

‘I don’t see the decision of asking Scrutiny to consider the work as a deferral; it is a balanced and achievable way of embedding it in to the policies of this council and doing it properly to make it achievable and sustainable. We are going to work with the County Council and all the partners’.

 

 

4. The Mayor read out the next question submitted by Ms Dianne Standen who was not present at the meeting -

‘Running vehicle engines unnecessarily whilst stationary has been illegal since Feb 1998. Vehicle emissions contribute to climate change and poor air quality.
Will Allerdale Council ensure that all operators of vehicles used on Council business comply with this legislation?’

 

Councillor M Fitzgerald responded by saying;

‘I can confirm that the Council has every intention of ensuring that it complies with all the relevant legislation, including working with contractors, to avoid situations where engines are left running’.

 

 

5. Councillor Markus Campbell-Savours submitted the following question -

‘Following the announcement in July, that the council would be suspending the collection of garden waste and mixed recyclates, a letter informing residents of the decision was sent out in the name of the Leader of the Council.

How many homes was this letter sent to? How much did this communication cost to send? Who has paid/is paying for this communication? Have the waste contractor (FCC) been asked to pay for this communication or any other communications with the public?’

 

Councillor M Fitzgerald responded by saying;

‘The number of homes the letter was sent to was 47,307, the cost was £20,305.77 plus VAT, it was the Council that paid for the communication, FCC the contractor has not so far been asked to contribute to that communication or any others’.

 

Councillor M Campbell-Savours asked a supplementary question;

‘That is quite a lot of money to spend on a letter and especially a letter that some people in my town found was lacking in useful information and I would ask is there a better, cheaper, smarter way of doing this in future. Surely we have got electronic means of communicating with people and we can maybe target our communication in so that elderly and vulnerable residents are communicated with in a more traditional way’.

 

Councillor M Fitzgerald responded by saying;

‘The letter went out in an emergency situation as you know. As my own contact details were on there I dealt with a lot of responses to it and generally found that once someone who had contacted had taken the time to understand any further information that I had provided they generally understood the situation as it was. The letter wasn’t the only communication means that we used we used every channel available to us, it was on the website, the councils Facebook etc and we have worked hard to make sure that the public have had as much information available to them as possible at any given time’.

 

 

6. Councillor Mike Heaslip submitted the following question;

‘At the July meeting of Council, Cllr Kemp undertook in response to a question from myself to include a statement in his Executive Report to this Council meeting on progress with the Moorclose Soccer Hub and on progress with preparing the Lottery submission for Workington Hall Parklands: as those matters are not referenced in the Executive report today, will Cllr Kemp now make that statement to Council?’

 

Councillor G Kemp responded by saying;

‘We are looking at the potential of bringing back the Moorclose football pitch site, the old leisure centre site, into full use with an improvement scheme looking at improving the quality of the pitches, the layout of pitches, landscaping, changing rooms of some description. We have had grounds reports done and some sample drawings and estimated costings. We are meeting with the Moorclose Community Centre to see what current use is for football, if we can use the facility to service teams using the outdoor pitches currently and some joint thinking on the future way forward. We have potential support from the Cumberland FA through the Football Foundation to support a scheme on the site and we have put an expression of interest in to the CLEP as part of some capital funding they have available. Over the next few months, we hope to be taking it forward if we can.

Alongside this, we are undergoing a Local Playing Pitch Plan for football pitches across Allerdale funded by the FA, this will help us evidence the need for pitches in the area and any ancillary facilities.

 

I didn’t mention the Workington Hall Parklands in my portfolio briefing as there’s nothing specific to report just now. However, we are working towards a re-submission of our application to the National Lottery Heritage Fund, which was unsuccessful first time around. We were encouraged to re-submit by the NHLF regional director and I’m aiming for a submission early in the New Year.The re-submission will involve a tweaking to the original bid rather than a major shift in content/emphasis’.

 

 

7. Mr Billy Miskelly submitted the following question;

‘Would the Leader of Allerdale Borough Council, Councillor Marion Fitzgerald please confirm or deny that due to the extreme cost associated with the Bin and recycling issue that this council has had to endure alongside the continuing extreme cost of finding a full and permanent solution to this issue that there are no funds available to this council now or within the lifespan of this councils administration to develop a Allerdale Stadium to be shared by Workington Reds and Workington Town of any size what so ever.

I am aware that at the meeting of the Executive Committee of Allerdale Borough Council held on Friday 28th June 2019, that the executive instructed that the Officers of this council carry out the proposal of the Deputy Leader of the Council, Councillor Mark Jenkinson which was, That officers continue to work on the business case, in so doing, they reduce the size and specification of the stadium.

 

I am also aware that at the last meeting of the Executive Committee of Allerdale Borough Council which was closed to the press and members of the public that the said Stadium was not on the agenda or mentioned.

I am aware that in his portfolio holder report presented at this meeting that the Deputy Leader Councillor Mark Jenkinson has stated that there have been ongoing discussions between Workington Reds and Workington Town and a joint project board has been established to meet on a regular basis to talk. The Deputy also stated that it is hoped that some facilities which were in the previously proposed for inclusion in a new stadium would now developed for the lower Derwent valley.

I am also aware that during talks involving The Reds that took place last Friday 20th September 2019 nothing new came to light or any commitment made. I would like to point out that you can have as many talks and committees as you like but if there is no finance available and none likely to become available it’s just talk, the people of Allerdale deserve the truth, and it is a fact that at no time has this administration made a financial commitment for this new Stadium to anyone’.

 

Councillor M Fitzgerald responded by saying;

‘I deny that the costs associated with the recent issues around the councils waste and recycling services have led to a situation where there are no funds available for the council to develop a community sports village.

Additional costs that were incurred for the waste and recycling service, they have been met from existing budget which are entirely separate from the funding for the sports village. Very good progress is being made for the early stages of the project’.

 

Mr Miskelly asked a supplementary question;

‘Would the Leader give me an anticipated date when she could announce when a financial commitment would be made to this project not just talk’.

 

Councillor M Fitzgerald responded by saying;

‘I can’t give you a date at this stage but I can assure you that talks with Workington Reds and Workington Town are going extremely well at the moment and we are drawing up plans’.

Councillor Sally Lansbury submitted the following Motion –

 

‘Extreme weather events over the last few years have presented severe challenges to property, transport, agriculture and other services in the Allerdale Borough Council area and have led to the deaths and displacement of thousands of people worldwide. The MET Office clearly states that these kind of extreme weather events are significantly more likely on a planet with human-caused climate change.

 

According to the Intergovernmental Panel on Climate Change 1.5C report, published in October 2018, humanity has 11 years for “ambitious action from national and sub-national authorities, civil society, the private sector, indigenous peoples and local communities” to deliver the “rapid and far reaching transitions in land, energy, industry, buildings, transport, and cities” needed to turn this around, so we can avoid reaching tipping points where we would no longer have the ability to avoid extreme weather events. Business as usual is clearly no longer an option.

 

Bold climate action can deliver economic benefits in terms of new jobs, economic savings and market opportunities, as well as improved well-being for people locally and worldwide.

 

A rapidly growing number of Parish, Town, City & District Councils, together with the Mayor of London, have passed motions declaring a ‘Climate Emergency’. A number of Local Authorities have also signed up to the UK100 Agreement, pledging to achieve 100% ‘clean energy’ usage by 2050 in their region. But the recent IPCC report shows it is imperative that this target is reached much sooner.

 

Allerdale Borough Council is committed to reducing carbon emissions, both as an organisation and as the Local Planning Authority and resolves to go further than the UK100 Agreement and to act in line with the scientific consensus that we must reduce emissions to net zero by 2030, and therefore commits to:

  • Work with partners in local sustainability organisations and Parish, Town and County Councils to help to deliver this goal through strategies, plans and shared resources
  • Work with relevant officers to divest from fossil fuels and to invest in ethical funds
  • Pledge to make Allerdale carbon neutral by 2030
  • Call on Government to provide the policy changes & funding to make the 2030 deadline possible
  • Report to full Council with the actions the council will take to address this emergency, within six months, in time for their recommendations to be funded in the next budget cycle
  • Establish an ethical procurement framework to ensure suppliers reduce their carbon footprint

 

And to take the following actions:

 

  Ensure that political and chief officer leadership teams embed this work in all areas of the Council Plan and take responsibility for reducing, as rapidly as possible, the carbon emissions resulting from the Council’s activities, ensuring that any recommendations are fully costed and that the Executive and Scrutiny functions review council activities taking account of production and consumption emissions and produce an action plan within 6 months, together with budget actions and a measured baseline;

The Mayor moved that the Motion submitted by Councillor P Scott would be considered first.

 

Councillor P Scott moved the following Motion –

 

‘I would like to propose that Allerdale Borough Council acknowledge the performance of one of its own. Ben Stokes has worked tirelessly in his career and put Cockermouth on the map with his dedication and commitment.

Ben Stokes is the son of Gerard and Deborah Stokes and moved to England at the age of 12 after his father was appointed head coach of Workington Town Rugby League club. Ben grew up in Cockermouth and attended Cockermouth School, playing cricket for Cockermouth Cricket Club. He won the North Lancashire & Cumbria Cricket League Premier Division Title with the club as a 15 year old in 2006. Ben Stokes holds the following list of achievements;

 

- Second-fastest Test double hundred in terms of balls faced

- Fastest 250 in Tests for which he took 196 balls

- Second highest number of sixes in a Test innings – 11 sixes

- Most runs in a Test innings at the sixth position – 258 runs

- Most runs in the first session of a day in Tests – 130 runs

- Highest Test partnership for the sixth wicket

- Man of the Final in Cricket World Cup – 2019

 

More so with his performance in the second innings of the present Ashes series, Ben secured the 3rd test for England with a workman like batting performance and again secured player of the match.

I firmly believe 2019 belongs to Ben Stokes and to acknowledge this and all of his achievements I call an extraordinary meeting of Council to award him the position of Freeman of our Borough.’

 

This was seconded by Councillor A Smith who was in full support of the motion. Councillor A Smith said he could remember when Ben must have been around 15 years old, he applied to Cockermouth Town Council for funding and the Town Council gave him £150 towards a bursary, and commented that that was possibly the best £150 the Council had ever spent.

 

Councillor M Heaslip commented there was only one disturbing aspect of the Ben Stokes affair which was the behaviour of the The Sun newspaper and asked that the Council record its support for Ben and his family in response to that appalling behaviour.

 

A vote was taken; the vote was unanimous. The motion was carried.

 

 

In moving her motion Councillor S Lansbury added that tonight a petition of over 1,200 signatures from constituents across West Cumbria had been presented to the Council and that she presented this motion to represent their views, to join Carlisle, Eden, South Lakes and 230 other UK Councils to declare a Climate Emergency.

Globally, the last 5 years have been the hottest 5 years on record.  June and July 2019 were the two hottest months ever. Once in a lifetime flooding, is happening regularly – often in our own Borough as we know too well.  Rising sea levels, unprecedented heatwaves, hurricanes other devastating weather events now seem common. 

 

She continued, it may feel strange to make a Climate Emergency Declaration in the shadow of the temporary suspension of our recycling services, however, what the contract dispute has shown everyone is just how much unnecessary waste each and every household in Allerdale needs to deal with. The problem of the bins is a temporary issue which is being addressed and solved.  Climate change is a long term and urgent issue which also needs to be addressed and we have to do it now. 

 

What the Climate Emergency Motion asks is that Allerdale establishes a policy framework and action plans for the Borough to reach a carbon neutral target by 2030.

 

This was seconded by Councillor A Smith.

 

Councillor C McCarron-Holmes was in support of the motion. She said climate change was rising to catastrophic proportions and locally we need to be reducing our carbon footprint. She said the decision by Central Government to endorse plans to leave the carcasses of the oil rigs on defunct oil filed installations is equally bad. The content of these rigs qualified as hazardous waste, they should be decommissioned within the international laws.

 

Councillor M Jenkinson said the submitted Motion came to Council with suggested solutions however none included costings; that the new administration had inherited a £2.3m deficit position and some of the requests could have a significant financial impact. He also felt that a 30 minute debate was not enough for implementing such huge decisions.

 

Councillor M Jenkinson moved an amendment to the motion; full wording as attached to the minutes.

 

This was seconded by Councillor M Fitzgerald.

 

Councillor A Pitcher rose in support of the amendment and said it would be added in to the Scrutiny work programme, with timescales, so progress would be made. He continued that the Council needed to work with other agencies and discuss with them what was achievable.

 

Councillor M Heaslip commented that the £2.3m budget shortfall mentioned earlier was entirely due to the actions of Central Government it was not a shortfall created by this Council.

Councillor Heaslip was opposed to the amendment saying the danger was if you remove the commitment to reduce emissions to net zero by 2030, or restrict it by saying only applies where it does not negatively impact on our communities, he said if we don’t do that there will be a huge impact on our communities. We’ve got to weigh in the balance of what we mean by negative impact on our communities.

 

Councillor P Scott was in support of the amendment and said it showed a stronger commitment from the Council, that we are putting it through a designated Scrutiny Panel that can do the work making it in to a deliverable Policy, rather than just a 30 minutes debate.

 

Councillor A Semple was opposed to the amendment. He said as a Cockermouth councillor a surgery was held recently at the Kirkgate Centre and the number of young people that attended he had not seen that amount of young people coming to political things before. He felt it was something that was definitely engaging. It would be a bigger impact on our communities if we do nothing.

 

Councillor M Fitzgerald said the amended motion was very little different to the original proposal; we feel that it is such an important issue that it needs to be properly embedded in the Councils policy and that can’t properly be done on the back of a 30 minute discussion here tonight. She said we need to call on the services of the Scrutiny Committee who already have it on their work plan to look at all the points included and bring a report back to Council then we can proceed to embed it in to policy.

 

Councillor J Farebrother was against the amended motion mainly because of the misunderstood role of Overview and Scrutiny. She said their task is not to put forward ideas and policies their role is to scrutinise what the Executive do. It is up to the Executive to come forward with ways of cutting our carbon footprint and for Scrutiny to see whether those are actually doable.

 

Councillor M Campbell-Savours said he didn’t see why the Executive were looking to hide behind Overview and Scrutiny; we are not asking you to spend 30 minutes looking at this we are asking the Executive to go and look at it and turn it in to something else. With regards to the investments he said, we are not alone here, there is a movement in this County of people trying to drive change. We want to join that movement, there will be challenges but let’s not hide and say it can’t be done.

 

In her right of reply Councillor S Lansbury said she understood that the suggestions of the detail were difficult to agree in one evening but within the points in the original motion we have already got that Scrutiny considers the impact of climate change and the environment when reviewing council policies and strategies however the most important thing is that it is urgent to pass this emergency motion tonight for the benefit of your communities. Young people are starting to feel climate despair and mental health issues are coming up as a result of this; they can’t see how their future is going to develop. Please respect the 1000’s of youth strikers and the 1300 who have signed the petition. She concluded, show your people that you care, it can’t always be cost driven sometimes it’s the value of the long term gain not the short term cost savings.

 

Councillor S Lansbury requested a recorded vote. A vote was taken on the request for a recorded vote, which was approved.

Councillor T Annison made a speech which sought to explain to the residents of his Warnell ward why he decided to leave the Conservative Party following the local elections in May.

To consider reports from Members of the Executive.

Minutes:

Councillor M Fitzgerald, Leader of the Council, presented the Portfolio Holders update report.

 

Questions were asked around the results of the recent Peer Challenge on the Council, preparations for Brexit, progress on the community stadium, options for collaboration with other districts, maintenance of Keswick car parks, preparations for the Taste Cumbria festival and the Cockermouth Junior Football Club facilities.

 

Councillor M Campbell-Savours asked what the collection rates had been like over the last couple of weeks since the bin collections had restarted and also what the collection rates were on assisted collections.

Councillor G kemp agreed to find out the information and report back.

 

Councillor E Lynch asked whether it could be confirmed that the £50k promised by this Council earlier in the year to Wigton Town Council towards a major project to provide changing rooms at the Barton Laws playing field in Wigton was part of the Leisure Strategy, or was it in the council’s budget for 2019-20, and if not, could it be included in the Leisure Strategy.

Councillor G Kemp agreed to find out and report back.

 

On the Self-Build Custom Housebuilding Policy and grant funding Councillor C McCarron-Holmes asked for assurances that the traditional building profession be supported. Councillor S Stoddart suggested a meeting be arranged to discuss further.

 

Councillor M Heaslip asked for an update on the One Public Estate programme.

Councillor M Jenkinson agreed to provide an update following the meeting.

The Head of Governance and Monitoring Officer submitted a report which sought Council to approve a scoping document and Terms of Reference, as attached at Appendix 1 of the report, for the Constitution Working Group review of the Councils Governance arrangements.

The Electoral Services Manager submitted a report which sought members to consider a petition requesting a Community Governance Review of the Flimby ward of the Maryport parish area and a Community Governance review of the boundary of Silloth-on-Solway parish area.

 

Councillor C Armstrong moved the recommendations within the report; this was seconded by Councillor N Cockburn.

 

Councillor M Heaslip moved an amendment to recommendation 4, detailed under paragraph 8.4 of the report, requesting that the following be added at the end of the paragraph;

‘provided that the recommendations in respect of each Town be voted on in the review group by adoption as recommendations only by those councillors who represent the Town to which the recommendation relates, to avoid the possibility of one Town’s Councillors imposing something on the other Town Council that those councillors don’t agree with’.

 

The Monitoring Officer highlighted that the amendment would create an issue with the quorum of the Working Party, in the terms of reference in the report the recommended quorum was four, if the amendment was accepted the quorum would have to be one as there was one representative for Flimby. It was agreed that Council note the comments raised and due regard would be given to the Ward members during the reviews due to their local knowledge and experience.

 

Councillor M Heaslip accepted the explanation and withdrew his amendment.

 

A vote was taken, 41 in favour, 0 against and 0 abstentions.

The vote was unanimous; the motion was carried.

1.  A Community Governance Review be carried out of the Maryport Parish area to consider:

·  The establishment of a separate parish council for the Flimby ward and associated electoral arrangements

·  Ward boundaries of Maryport Town Council

·  Council size of Maryport Town Council

 

2.  A Community Governance Review be carried out of the Silloth-on-Solway Parish area to consider amendments to the parish boundary with the Holme Low parish area

 

3.  The Terms of Reference for the Community Governance Reviews, as set out at Appendices 1 and 2 to the report, be agreed

 

4.  A Community Governance Review Working Party consisting of the nine members from the Flimby, Maryport North, Maryport South and Silloth & Solway Coast wards be established to co-ordinate the reviews and to make final recommendations to Council.

Minutes:

The Democratic and Support Services Manager submitted a report which sought members approval for an extension of non-attendance of Councillor J Colhoun due to ill health.

 

Councillor A Smith moved the motion which was seconded by Councillor M Jenkinson. The motion was unanimously agreed.

 

Resolved

 

That the period of non-attendance for Councillor J Colhoun be extended beyond the six months, in accordance with Section 85(1) of the Local Government Act 1972, on the grounds of ill health and extends the period for a further six months to expire on 22 May 2020.
