Minutes: The Monitoring Officer advised members that Councillor Stoddart had indicated that he could not attend the hearing due to being on holiday and requested an adjournment.
The Panel decided that there was insufficient reason for such failure to attend and decided to consider the matter and make a determination in the absence of Councillor Stoddart.
The Standards Hearings Panel, a Sub-Committee of Allerdale Borough Council Standards Committee, determined a complaint to the Standards Committee in relation to allegations by Councillor Peter Bales that Councillor Stephen Stoddart of Workington Town Council breached the following provisions of Workington Town Council’s Code of Conduct in force prior to 8 August 2012:
1 Paragraph 3(1)
Failing to treat others with respect
2 Paragraph 3(2)
Bullying and intimidating another person
The Hearing Sub Committee considered the evidence contained in the Investigating Officer’s report.
As this complaint was considered under the new regime, the Standards Hearings Panel considered the current Code of Conduct for Workington Town Council, in force as of 8 August 2012, and felt that the following provisions were relevant:
1 Paragraph 5(4)
You must not bring your office or the Council into disrepute
2 Paragraph 5(5)
You must treat others with respect and promote equality by not discriminating unlawfully against any person, and by treating people with respect, regardless of their sex, race, age, religion, gender, sexual orientation or disability. You should respect the impartiality and integrity of the authority’s statutory officers and its other employees.
The Standards Hearings Panel found that Councillor Stephen Stoddart had failed to comply with the Code of Conduct and
Agreed –
a) That a formal letter be sent to Councillor Stoddart
b) That the panel’s findings be reported to Workington Town Council
c) That Workington Town Council be recommended to arrange Code of Conduct Training for Councillor Stephen Stoddart
