The Head of Development Services outlined the item. At the Development Panel meeting on 30 May 2017 planning application 2/2016/0751 was refused planning permission and was now the subject of a planning appeal with a public inquiry scheduled for May 2018. Counsel had been instructed to review the case and represent the Council at the public inquiry. Advice from Counsel was appended for consideration by Members and recommended that 2 of the 4 stated reasons for refusal not be contested by the Council for the reasons set out in the advice. Members were asked to consider the advice.

 

Councillor D Wilson moved that the Council confirm, through its submission of the statement of case that it did not intend to present evidence to defend the following stated reasons for refusal for planning application 2/2016/0751 in the appeal:

 

  1. The Local Planning Authority considers that the proposed development would result in an intensification of the use of a number of sub-standards junctions, in particular the Little Brow and Harris Brow junction, to the detriment of pedestrian and highway safety contrary to the provisions of policies S5 and S32 of the Allerdale Local Plan – Part 1.

 

  1. That the proposed development outside the settlement boundary would be premature in advance of the review of the boundaries and housing allocations in the Allerdale Local Plan (Part 2) – Site Allocations.

 

Councillor T Annison seconded the motion.

 

A vote was taken. The motion was unanimously agreed.
